FCC ADOPTS PILOT PROGRAM UNDER RURAL HEALTH CARE MECHANISM
 
Pilot will Enhance Access Health Care Providers’Access to Advanced Telecommunications and Information Services
    Washington, D.C. – Today, the Federal Communications Commission (FCC) adopted an Order that establishes a pilot program to help public and non-profit health care providers build state and region-wide broadband networks dedicated to the provision of health care services, and connect those networks to Internet2, a dedicated nationwide backbone.  The construction of such networks will bring the benefits of innovative telehealth, and particularly, telemedicine services to those areas of the country where the need for those benefits is most acute. 
 
Broadband communications is enabling health care providers to vastly improve access to quality medical services.  This is particularly true in underserved areas of the country that lack access to the breadth of medical expertise and advanced medical technologies available in other areas.   Among other things, telehealth applications, including telemedicine, allow patients to access critically needed medical specialists in a variety of practices, including cardiology, pediatrics, and radiology, without leaving their homes or communities.  Use of these technologies can reduce hospital stays and the costs of medical care, as well as facilitate transmission of emergency medical records among doctors and health care facilities.
                                                                                                                                                           
            Despite the Commission’s efforts to make it more viable and reflect technological changes, the existing Rural Health Care funding mechanism remains underutilized.  The pilot program adopted today will work within the parameters of the existing program to explore ways in which the Rural Health Care funding mechanism can best be used to further the goal of Congress and our rules to enhance public and non-profit health care providers’ access to advanced telecommunications and information services.   Moreover, the pilot program will provide the Commission useful information as to the feasibility of revising the Commission’s current rural health care rules in a manner that best achieves the objectives set forth by Congress. 
 
The pilot program is designed to encourage health care providers to join together to aggregate their needs and develop a strategy for creating statewide and/or regional networks that will connect numerous health care providers, including rural health care providers, through a dedicated, broadband network.  The pilot program will fund up to 85% of the costs incurred to deploy state or regional broadband networks dedicated to health care.  The pilot program will also fund up to 85% of the costs of connecting the regional and/or statewide to Internet2, a dedicated nationwide backbone that connects a number of government research institutions, as well as academic, public, and private health care institutions that are repositories of medical expertise and information.
 
    The funding amount will be capped at an amount not to exceed the difference between the amount of monies committed under the existing program for the current year and $100 million (25% of the annual $400 million cap on rural health care spending).  Interested parties should submit their applications to the Commission 30 days after Office of Management and Budget approval of the information collection requirements in the Order.

NIST announces the release of draft SP 800-82, Guide to Supervisory Control and Data Acquisition (SCADA) and Industrial Control Systems Security. SP 800-82 provides guidance for establishing secure industrial control systems (ICS), including supervisory control and data acquisition (SCADA) systems, distributed control systems (DCS), and other smaller control system configurations such as skid-mounted Programmable Logic Controllers (PLC). ICSs are typically used in industries such as electric, water, oil and gas, transportation, chemical, pharmaceutical, pulp and paper, food and beverage, and discrete manufacturing (automotive, aerospace, and durable goods). The document provides an overview of ICSs and typical system topologies, identifies typical threats and vulnerabilities to these systems, and provides recommended security countermeasures to mitigate the associated risks. Charlotte BPL Trial Expands - From 500 users to
possibly 6,000, Broadband Reports, 9/26/2006
Duke Energy Corporation will expand a broadband over
power line trial in Charlotte from 500 customers, to
closer to 6,000, according to the Charlotte Observer.
The trial uses gear from Ambient Corporation, who last

FCC Announces E911 IP Disability Access Summit

FCC ANNOUNCES E9-1-1 DISABILITY ACCESS SUMMIT

The FCC will hold a Summit to focus on E9-1-1 calling
and access for persons with hearing and speech
disabilities on Wednesday, November 15, 2006. Last
year, the Commission initiated a proceeding seeking
comment on how the Commission can ensure that
consumers using Internet-based forms of
Telecommunications Relay Services (TRS), specifically
Video Relay Services (VRS) and Internet Protocol Relay
(IP Relay), can access emergency services in the same
way as all other consumers. In the Matter of
Telecommunications Relay Services and Speech-to-Speech
for Individuals with Hearing and Speech Disabilities,
FCC 05-196, 20 FCC Rcd 19,476 (2005). Internet-based
TRS calls do not originate on the PSTN and therefore
present unique challenges. The E9-1-1 Disability
Access Summit is intended to provide an opportunity to
explore challenges and potential solutions for users
of Internet-based TRS services to access Public Safety
Answering Points (PSAPs) by calling 9-1-1.

The goals of the Summit are:
(1) To identify the various types of direct
Internet-based E9-1-1 access that people with hearing
or speech disabilities need;
(2) To identify the technologies, services, and
applications through which access should be offered;
and
(3) To define the technological, policy, and
commercial issues involved in providing the needed
access to persons with hearing and speech
disabilities.

Participants will include representatives of other
federal agencies; state and local emergency service
providers; telecommunications and TRS industry;
hearing and speech disability advocates; and FCC
staff. Lessons learned from this Summit will help the
FCC design and focus efforts to improve emergency
communications access for persons with hearing and
speech disabilities. The Summit is open to the public
and seating will be available on a first-come,
first-served basis. The Summit will include panel
discussions on the following three topics: needs of
the hearing and speech disability communities; state
of technology; and, interim options and solutions.

FCC SEEKS APPLICANTS FOR 2006/2007
ENGINEER-IN-TRAINING PROGRAM
Competitive Program Aimed at New and Recent
Engineering School Graduates

Washington, D.C. - The Federal Communications
Commission today announced that it is seeking
applications from engineering school graduates with
superior academic credentials and an interest in
communications engineering and IP networks for its
Engineer-in-Training (EIT) Program to be held during
2006/2007. Through the EIT Program, the FCC will
recruit recent engineering school graduates to the FCC
and provide comprehensive training in the field of
communications.

The FCC will accept applications from recent
engineering graduates or soon-to-be graduates for
multiple openings in the EIT Program during three
application windows:

(1) August 7, 2006, through August 28, 2006
(2) October 1, 2006, through October 22, 2006
(3) March 30, 2007, through April 21, 2007

All EIT Program participants will receive training in
Washington, DC. Engineers hired as part of the EIT
Program will fill positions located at the FCC’s
headquarters in Washington, DC, its Gettysburg, PA
facility, or one of the existing FCC field offices
that are located throughout the United States. The
FCC’s field offices are located in Atlanta, GA;
Boston, MA; Chicago, IL; Columbia, MD; Dallas, TX;
Denver, CO; Detroit, MI; Kansas City, MO; Los Angeles,
CA; New Orleans, LA; New York, NY; Philadelphia, PA;
San Diego, CA; San Francisco, CA; Seattle, WA; and
Tampa, FL. Applicants must specify all locations for
which they wish to be considered.

Interested candidates must submit all information
requested in FCC Vacancy Announcement Number
DEU-EIT-2006-0001 including a cover letter, resume,
writing sample, official school transcript, geographic
preference and list of references when applying for
consideration. Incomplete applications will not be

REQUIREMENTS FOR INTERCONNECTED VOIP PROVIDERS AND
ANNOUNCES OMB APPROVAL OF NEW FCC FORMS 499-A AND
499-Q

On June 21, 2006, the Commission adopted the 2006
Interim Contribution Methodology Order, which included
proposed revised FCC Forms 499-A and 499-Q and their
instructions. In pertinent part, the Order requires
that interconnected Voice over Internet Protocol
(“interconnected VoIP”) providers contribute to the
universal service fund (USF) and raises the wireless
safe harbor from 28.5 percent to 37.1 percent. The
revised Forms and their instructions reflect the
changes to the contribution methodology adopted in the
2006 Interim Contribution Methodology Order.

On June 28, 2006, the Commission requested emergency
approval of the information collection requirements
from the Office of Management and Budget (OMB). On
July 27, 2006, the Commission received OMB approval.

For the convenience of new filers, particularly
interconnected VoIP providers, we provide these
instructions and special accommodations to simplify
the process for the filing due August 1:

• For all filers, the FCC Form 499-Q filing must be
filed with the Universal Service Administrative
Company (USAC) by August 1, 2006. For providers who
have not previously filed, FCC Form 499-A also must be
filed with USAC by August 1, 2006. USAC has made the
Forms available on its website at

are also available on the Commission’s website at

• Interconnected VoIP providers that have not

• Normally, filers obtain a Filer 499 ID for use on
the Forms by filing their initial Form 499-A and then
receiving the Filer 499 ID from USAC. Out of
consideration of the deadlines for interconnected VoIP
providers to file both Forms by August 1, we have
directed USAC to accept the Forms without the Filer
499 ID (for those providers who do not already have a
Filer 499 ID). USAC will provide the Filer 499 ID to
the providers later and will fill in the Filer 499 ID
on the Forms filed by August 1 on behalf of these
providers. New filers that use this process should
submit the two Forms together to USAC in a single
filing. (Although new filers have the option of
sending FCC Form 499-A either to USAC or to the Office
of the Secretary, we encourage new filers to send FCC
Form 499-A (along with FCC Form 499-Q) to USAC.).
• We clarify that interconnected VoIP providers filing
for the first time need only complete limited portions
of the Forms for the August 1 filing, which include
only two lines of revenue information in total:
o On the FCC Form 499-A, interconnected VoIP providers
need only complete block 1 (contributor identification
information), block 2 (contact information, agent for
service of process, and registration), and block 6
(certification). Interconnected VoIP providers need
not complete block 3 (carrier’s carrier revenue
information), block 4 (revenue information), or block
5 (additional revenue breakouts).
o On the FCC Form 499-Q, interconnected VoIP providers
that have not previously contributed need only
complete block 1 (contributor identification
information), block 2 (contact information), block 4
(certification), and lines 114, 119, and 120 of block
3. They do not need to complete lines 113, 115, 116,
117, or 118 of block 3.

On December 23, 2003, the Commission adopted a rule
that formalizes the process for updating
the eligible services list for the schools and
libraries universal service support mechanism.1 Under
this
rule, the Universal Service Administrative Company
(USAC) is required to submit annually a draft
eligible services list for the following funding year.
The rule also requires that the Commission issue a
Public Notice seeking comment on USAC’s proposed
eligible services list. Finally, at least 60 days
prior
to the opening of the window for the following funding
year, the rule requires the Commission to issue a
public notice attaching the final eligible services
list for the upcoming funding year.
We hereby seek comment on USAC’s attached proposed
eligible services list. We emphasize
that USAC’s description of eligible services is being
proposed for the sole purpose of informing potential
schools and libraries program beneficiaries of the
specific products and services that may be eligible to
receive discounts under the Schools and Libraries
Support Mechanism pursuant to section 254. We also
emphasize to commenters that this proceeding is
limited to determining what services are eligible
under
the Commission’s current rules; it is not intended to
be a vehicle for changing any eligibility rules.
Pursuant to sections 1.415 and 1.419 of the
Commission’s rules, 47 CFR §§ 1.415, 1.419,
interested parties may file comments and reply
comments on or before the dates indicated above.

On June 13, 2006, and July 13, 2006, respectively,
Qwest Corporation and Qwest Communications Corporation
(jointly, Qwest), and AT&T Inc. (AT&T) filed petitions
for forbearance pursuant to section 10(c) of the
Communications Act of 1934, as amended (the Act), 47
U.S.C. § 160(c). In its petition, Qwest asks the
Commission to forbear from applying Title II and the
Computer Inquiry rules to any broadband services Qwest
does or may offer to the extent those services are not
offered as part of an Internet access service. AT&T,
in its petition, asks the Commission to forbear from
applying Title II and the Computer Inquiry rules to
non-time division multiplex (non-TDM) based broadband
transmission services offered by AT&T and other Bell
Operating Companies.
This Public Notice establishes certain procedural
requirements relating to consideration of the Qwest
and AT&T petitions for forbearance. This matter shall
be treated as a “permit-but-disclose” proceeding in
accordance with the Commission’s ex parte rules. See
47 C.F.R. §§ 1.1200, 1.1206. Persons making oral ex
parte presentations are reminded that memoranda
summarizing the presentations must contain summaries
of the substance of the presentations and not merely a
listing of the subjects discussed. More than a one or
two sentence description of the views and arguments
presented generally is required. See 47 C.F.R. §
1.1206(b). Other rules pertaining to oral and written
ex parte presentations in permit-but-disclose
proceedings are set forth in Section 1.1206(b) of the
Commission’s rules, 47 C.F.R. § 1.1206(b).
Pursuant to Section 1.415 and 1.419 of the
Commission’s rules, 47 C.F.R. §§ 1.415, 1.419,
interested parties may file comments on the Qwest and
AT&T petitions for forbearance on or before August 3,
2006 and reply comments on or before August 18, 2006.
