The Federal Communications Commission would like to announce the creation of a new senior level advisory position, the Distinguished Engineering Fellow.

Analogous to the Chief Economist position, the Distinguished Engineering Fellow will work out of the Office of Strategic Planning and Policy Analysis, the Commission's primary source of long-range communications policy development, analysis and evaluation. Candidates should have expertise in some or all of the following areas: TCP/IP, routing, interconnection, peering, transit, IPv6, security, network performance, spam, Next Generation Networks, Internet over broadband, and VoIP. He or she will advise the Commissioners and staff on these and related engineering issues, working closely with Commission engineers, MBAs, economists and lawyers to analyze new technological developments.

Level 3 Communications (Nasdaq:LVLT) and Cogent Communications (Amex:COI) today announced that the companies have agreed on terms to continue to exchange Internet traffic under a modified version of their original peering agreement. The modified peering arrangement allows for the continued exchange of traffic between the two companies’ networks, and includes commitments from each party with respect to the characteristics and volume of traffic to be exchanged. Under the terms of the agreement, the companies have agreed to the settlement-free exchange of traffic subject to specific payments if certain obligations are not met.

Location of a caller is essential to processing an emergency call. Location is needed to correctly route the call, and to correctly dispatch help to the right place. Location can be specified in geographic (latitude, longitude) or civic (country, province, locality) forms. A press release on the ICANN web site says that ICANN and Verisign have agreed to settle all pending lawsuits, and there’s a new .COM agreement, all tentative but if history is any guide, nothing short of DOC action is going to stop it. The good news is that VeriSign has agreed not to make unilateral changes like Sitefinder. They have to give prior notice to ICANN for any material change in the operation of the registry, and if ICANN has any concerns there’s a lengthy process full of expert panels and Consensus and the like to decide whether they can do it.

of Control (WC Docket No. 05-65).
SUMMARY: The Commission will consider a Memorandum
Opinion and Order concerning the proposed transfer of
licenses and authorizations from AT&T Corp. to SBC
Communications Inc.

4 WIRELINE COMPETITION TITLE: Verizon Communications
Inc. and MCI, Inc. Applications for Approval of
Transfer of Control (WC Docket No. 05-75).
SUMMARY: The Commission will consider a Memorandum
Opinion and Order concerning the proposed transfer of
licenses and authorizations from MCI, Inc. to Verizon
Communications Inc.

Secret Code in Color Printers Lets Government Track You, EFF, 10/18/2005
A research team led by the Electronic Frontier Foundation (EFF) recently broke the code behind tiny tracking dots that some color laser printers secretly hide in every document. The U.S. Secret Service admitted that the tracking information is part of a deal struck with selected color laser printer manufacturers, ostensibly to identify counterfeiters. However, the nature of the private information encoded in each document was not previously known.

SBC seeks a declaratory ruling that wholesale transmission providers using Internet protocol (IP) technology to transport long distance calls are liable for access charges. VarTec seeks a declaratory ruling that it is not required to pay access charges to terminating local exchange carriers (LECs) when enhanced service providers or other carriers deliver calls directly to the terminating LECs for termination. VarTec also seeks a declaratory ruling that such calls are exempt from access charges when they are originated by a commercial mobile radio service (CMRS) provider and do not cross metropolitan trading area (MTA) boundaries. VarTec also seeks a declaratory ruling that terminating LECs are required to pay VarTec for the transiting service VarTec provides when terminating LECs terminate intraMTA calls originated by a CMRS provider.

This new rule will enhance public safety and ensure that the surveillance needs of law enforcement agencies continue to be met as Internet-based communications technologies proliferate.

Jeff Pulver bangs his head against the wall as he realizes the FCC's order requiring certain VOIP services to comply with wiretapping requirements could sweep in far more than anticipated. This is the problem with the FCC's current approach to VOIP, which comes dangerously close to, "If it looks like a duck, and quacks like a duck, it's a duck." The problem is that inevitably turns the whole Internet into a collection of waterfowl.

FCC Finalizes VOIP/Broadband Wiretapping Rules, CDT, 10/14/2005
The Federal Communications Commission this week finalized its August 5 decision to force broadband Internet access and "interconnected VoIP" services to be designed to make government wiretapping easier, under the terms of the 1994 Communications Assistance for Law Enforcement Act (CALEA). The rule officially took effect October 13, when the FCC published it in the Federal Register. CDT and others are very likely to challenge the FCC's order in court, arguing that the decision exceeds the terms of the statute, imposes undue burdens on innovation and threatens the privacy of Internet users.
