Broadband Adoption in the United States: Growing but
Slowing, Pew, 9/30/2005
The report argues that, while broadband adoption has
grown quickly in recent years, there are reasons to
believe that it is slowing. The report develops a
model of broadband adoption that hypothesizes that the
intensity of online use is the critical variable in
understanding the home high-speed adoption decision
and the trajectory of the adoption curve. Using
national survey data from 2002 and 2005, the paper
shows that the role of online experience in explaining
intensity of internet use has vanished over this time
frame; the explanatory effect of having a broadband
connection has grown. This suggests that relative to
2002 there is not much pent-up demand for high-speed
internet use at home.

Calling All Techies (Net Guard), ACM, 9/30/2005
The aftermath of hurricanes Katrina and Rita has
revived an old idea that the federal government
maintain lists of rapid response teams comprised of
private sector technical experts to help rebuild after
a disaster or terrorist attack. Called the “NET
Guard,” Senator Ron Wyden (D-OR) originally proposed
this idea as part of the legislation that created the
Department of Homeland Security (DHS). The provision
(below) was included in the final agreement, but the
department has never implemented the program.

Enforcement Bureau Provides Further Guidance to
Interconnected Voice Over Internet Protocol Service
Providers Concerning Enforcement of Subscriber
Acknowledgement Requirement

In this Public Notice, the Enforcement Bureau (Bureau)
provides additional guidance concerning its intended
enforcement of the subscriber affirmative
acknowledgement requirement placed on interconnected
Voice over Internet Protocol (VoIP) service providers
in the Commission’s VoIP E911 Order. After
considering the reports submitted to us by
interconnected VoIP providers detailing their
compliance with the Commission’s notification
requirements, it is evident that many providers have
devoted significant resources to notifying each of
their subscribers of the limitations of their 911
service and obtaining acknowledgements from each of
their subscribers. Specifically, by repeatedly
prompting subscribers through a variety of means, the
majority of providers submitting September reports
have obtained acknowledgments from nearly all, if not
all, of their subscribers. For example, the September
reports indicate that at least 21 providers have
received acknowledgments from 100 percent of their
subscribers and at least 32 others have obtained
acknowledgements from 90 percent or more of their
subscribers. In recognition of these substantial
efforts and the very high percentage of received
acknowledgments, the Bureau announces that it will not
pursue enforcement action against such providers. We
do, however, expect these providers will continue
seeking the remaining acknowledgements and will notify
the Commission once they have achieved 100%
compliance.
To the extent that a provider has not received
acknowledgements from at least 90% of its subscribers,
we intend to continue forbearing from enforcement of
our acknowledgment requirement until October 31, 2005,
provided that these providers submit a status report
to us by October 25, 2005. This status report should
detail the efforts that they have undertaken to obtain
acknowledgments from the remainder of their subscriber
base, explain why they have been unable to achieve an
acknowledgment percentage closer to 100%, and provide
the current percentage of acknowledgments that they
have received as of the date of filing.

Filing Procedures

Interconnected VoIP providers may file the
above-referenced report in this proceeding on or
before October 25, 2005. Reports must reference WC
Docket No. 05-196 and should be labeled clearly on the
first page as “Subscriber Acknowledgement Report (date
of filing).” The report may be filed using: (1) the
Commission’s Electronic Comment Filing System (ECFS),
or (2) by filing paper copies. See Electronic Filing
of Documents in Rulemaking Proceedings, 63 Fed. Reg.
24,121 (May 1, 1998).

• Electronic Filers: Compliance letters may be filed
electronically using the Internet by accessing the
ECFS: http://www.fcc.gov/cgb/ecfs/. Filers should
follow the instructions provided on the website for
submitting comments. For ECFS filers, in completing
the transmittal screen, filers should include their
full name, U.S. Postal Service mailing address, and
the applicable docket number (WC Docket No. 05-196).

• Paper Filers: Parties that choose to file by paper
must file an original and four copies of each filing.
Filings can be sent by hand or messenger delivery, by
commercial overnight courier, or by first-class or
overnight U.S. Postal Service mail (although we
continue to experience delays in receiving U.S. Postal
Service mail). All filings must be addressed to the
Commission’s Secretary, Marlene H. Dortch, Office of
the Secretary, Federal Communications Commission, 445
12th Street, SW, Washington, DC 20554.

• The Commission’s contractor will receive
hand-delivered or messenger-delivered paper filings
for the Commission’s Secretary at 236 Massachusetts
Avenue, N.E., Suite 110, Washington, DC 20002. The
filing hours at this location are 8:00 a.m. to 7:00
p.m. All hand deliveries must be held together with

At TPRC over the last weekend, former FCC Chairman
Reed Hundt debated former FCC Chairman Dick Wiley.
Hundt was overtly political. It was absolutely clear
where he stood. Wiley was significantly more opaque;
often it was clear what he was against, but it was
hard to understand what he was for. Hundt wore it on
his sleeve -- he was all over the Republican Congress
for everything from Telecom malfeasance to Energy pork
to FEMA follies to Iraq idiocy to Global Warming to US
unilateralism and decline. Wiley kept it to telecom,
and even then he did not want to say very much.

Permanent, Temporary Barriers Interfering With

This weekend's mass service outage, though troubling,
is being overshadowed by the Government of Pakistan's
pursuit of permanent restrictions on Internet use in
order to raise revenue for the government-owned
telephone company there. Consumers in Pakistan were
reportedly hit hard by the recent outage, along with
high tech firms that do not qualify for preferential
satellite backup links, but a lack of critical
infrastructure in the country, combined with the
government's efforts to limit Internet use, may bar
the maturing of Pakistan's IT industry much more than
any temporary glitch.

Senate Passes PATRIOT, Adds Civil Liberties
Protections, CDT, 9/20/2005
The Senate approved an amended version of the Patriot
Act Reauthorization Bill by unanimous consent.
Although the measure, which was approved last week by
the Senate Judiciary Committee, does not go as far
toward restoring checks and balances as CDT would
like, it contains important reforms and is a better
bill for civil liberties than the bill approved by the
House of Representatives in July. CDT has drafted a
memo detailing the key provisions of, and differences

FCC Requires Certain Broadband and VoIP Providers to
Accommodate Wiretaps

Order Strikes Balance Between Law Enforcement,
Innovation

Washington, D.C. – Responding to a petition from the
Department of Justice, the Federal Bureau of
Investigation, and the Drug Enforcement Agency, the
Commission determined that providers of certain
broadband and interconnected voice over Internet
Protocol (VoIP) services must be prepared to
accommodate law enforcement wiretaps, the Federal
Communications Commission ruled today.
The Commission found that these services can
essentially replace conventional telecommunications
services currently subject to wiretap rules, including
circuit-switched voice service and dial-up Internet
access. As replacements, the new services are covered
by the Communications Assistance for Law Enforcement
Act, or CALEA, which requires the Commission to
preserve the ability of law enforcement agencies to
conduct court-ordered wiretaps in the face of
technological change.
The Order is limited to facilities-based broadband
Internet access service providers and VoIP providers
that offer services permitting users to receive calls
from, and place calls to, the public switched
telephone network. These VoIP providers are called
interconnected VoIP providers.
The Commission found that the definition of
“telecommunications carrier” in CALEA is broader than
the definition of that term in the Communications Act
and can encompass providers of services that are not
classified as telecommunications services under the
Communications Act. CALEA contains a provision that
authorizes the Commission to deem an entity a
telecommunications carrier if the Commission “finds
that such service is a replacement for a substantial
portion of the local telephone exchange.”
Because broadband Internet and interconnected VoIP
providers need a reasonable amount of time to come
into compliance with all relevant CALEA requirements,
the Commission established a deadline of 18 months
from the effective date of this Order, by which time
newly covered entities and providers of newly covered
services must be in full compliance. The Commission
also adopted a Further Notice of Proposed Rulemaking
that will seek more information about whether certain
classes or categories of facilities-based broadband
Internet access providers – notably small and rural
providers and providers of broadband networks for
educational and research institutions – should be
exempt from CALEA.
The Commission’s action is the first critical step to
apply CALEA obligations to new technologies and
services that are increasingly used as a substitute
for conventional services. The Order strikes an
appropriate balance between fostering competitive
broadband and advanced services deployment and
technological innovation on one hand, and meeting the
needs of the law enforcement community on the other.

Security firm Panda Labs has detected a worm that attempts to spoof Google. P2Load.A spreads via P2P networks using the file-sharing programs Shareaza and Imesh. The worm changes Web users' start page to one that closely imitates Google. When users run a search, the results are shown correctly or with slight variations in the order in which they would be shown in Google. However, the sponsored links, which are usually shown at the top of the search results and correspond to companies that pay for this service, are different.
